1. Introduction
Welcome to Cluvi, operated by TE tech ("Company", "we", "our", "us"). These Terms and Conditions ("Terms") govern your use of our website cluvi.io (the "Site") and our services. By registering as a "Creator" (Advertiser) or a "Clipper" (Publisher), you agree to be bound by these Terms.
2. Definitions
"Creator": A user, brand, or entity that uploads video content and funds campaigns to have content distributed.
"Clipper": A user, micro-influencer, or publisher who distributes Creator content to third-party platforms to generate organic viewership in exchange for performance-based fees.
"Services": The technology platform provided by Cluvi to connect Creators with Clippers for content distribution.
3. Account Registration
To use the Services, you must register an account. You agree to provide accurate, current, and complete information during the registration process.
For Clippers: You are responsible for providing valid tax (PAN) and banking information to receive payouts. Cluvi reserves the right to withhold payments if KYC (Know Your Customer) requirements are not met.
4. Services & Payment (For Creators)
Pricing: Pricing for distribution campaigns is dynamic and displayed on the campaign creation page. All prices are in INR and subject to applicable GST.
Payment Gateway: We use Razorpay to process campaign funding. By making a payment, you agree to Razorpay's terms of service.
Deliverables: Cluvi acts as a bridge. While we verify traffic quality, we do not guarantee specific conversion rates or sales results from the distributed content.
5. Payouts & Earnings (For Clippers)
Performance Tracking: Earnings are calculated based on "Qualified Views" as tracked by Cluvi's proprietary system.
Fraud Prevention: Any attempt to artificially inflate views using bots, scripts, click farms, or non-organic methods is strictly prohibited. Detection of such activity will result in immediate account suspension and forfeiture of all pending balances.
Payout Schedule: Payouts are processed monthly (or as otherwise stated in your dashboard) once your balance exceeds the minimum threshold.
6. Cancellation & Refund Policy
Refund Eligibility: Refunds are only available for campaign funds that have not yet been utilized or allocated to Clippers. Once a campaign is active and views are being generated, funds are non-refundable.
Process: To request a refund for unspent funds, email support@cluvi.io with your Transaction ID.
Timeline: Approved refunds will be processed within 5-7 business days to the original payment method via Razorpay.
7. Shipping & Delivery Policy
Digital Services: Cluvi provides strictly digital services. No physical products are shipped.
Service Activation: Upon successful payment, campaign tools and dashboards are activated immediately. You will receive a confirmation email at your registered address.
8. Limitation of Liability
Cluvi acts solely as an intermediary. We are not responsible for the content uploaded by Creators. Creators bear full liability for ensuring their content does not violate copyright or community guidelines of third-party platforms (e.g., YouTube, Instagram).
9. Governing Law
These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Delhi, India.
